Copyright & Content Policy

FOCL Galleries hosts photographs uploaded by the photographers who use it. We do not review that material in advance, and we do not claim ownership of it. This page explains how to report content you believe infringes your copyright, or that otherwise does not belong on FOCL, and what we do about it.

1. Reporting a copyright infringement

If you believe material on FOCL infringes a copyright you own or represent, send a notice to our designated agent at hello@getfocl.app with the subject line Copyright notice. Under the DMCA (17 U.S.C. §512(c)(3)) your notice must include:

• Your physical or electronic signature.
• Identification of the copyrighted work you say has been infringed.
• Identification of the material you are reporting, with enough detail for us to find it — the gallery link is the most useful thing you can give us.
• Your name, address, telephone number and email address.
• A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

An incomplete notice may delay our response. Please note that under §512(f) a person who knowingly misrepresents that material is infringing may be liable for damages.

2. What we do when we receive a notice

• We acknowledge the notice.
• Where it is valid and complete, we remove or disable access to the reported material, usually by making the gallery unreachable.
• We notify the account holder who uploaded it, and pass on your notice.
• We keep a record. Accounts that repeatedly infringe are terminated, in line with §512(i).

3. Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to hello@getfocl.app including your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you believe in good faith it was removed by mistake, and your name, address and telephone number, together with consent to the jurisdiction of the federal court for your district.

We may restore the material 10 to 14 business days after forwarding your counter-notice, unless the original complainant tells us they have filed an action seeking a court order.

4. Reporting anything else

To report material that is unlawful, that depicts you and that you want removed, or that otherwise breaches our Terms of Service, email hello@getfocl.app with the gallery link and what the problem is. This includes:

• Photographs of you that you did not consent to being published.
• A request to delete a face template generated for photo search — see our Privacy Policy.
• Material that is unlawful or that harasses or endangers someone.

You do not need a FOCL account to report anything on this page.

5. For photographers

You are responsible for holding the rights to what you upload, and for any permissions needed from the people who appear in it. If we receive a notice about your gallery we will contact you at the email on your account, so keep it current.
